1. Personal Data

We, Viridives GmbH, collect, process, and use your personal data only with your consent or upon your authorization or instruction for the purposes agreed upon with you, or if there is another legal basis in accordance with the GDPR; this is done in compliance with data protection and civil law provisions. We collect only those personal data that are necessary for the performance and processing of our services or that you have voluntarily provided to us. Personal data includes all data containing specific details about personal or factual circumstances, such as name, address, email address, telephone number, date of birth, age, gender, social security number, video recordings, photos, voice recordings of individuals, and biometric data such as fingerprints. Sensitive data, such as health data or data related to criminal proceedings, may also be included.

2. Access and Deletion

As a customer or, more generally, as a data subject, you have the right at any time to access your stored personal data, including its origin, recipients, and the purpose of data processing, as well as the right to rectification, data portability, objection, restriction of processing, and the blocking or deletion of inaccurate or unlawfully processed data. If there are any changes to your personal data, please notify us accordingly. You have the right at any time to revoke any consent you have given for the use of your personal data. Your request for access, deletion, correction, objection, and/or data portability—in the latter case, provided that this does not entail a disproportionate effort—may be directed to the law firm’s address listed in Section 8 of this statement. If you believe that our processing of your personal data violates applicable data protection law or that your data protection rights have been infringed in any other way, you have the option to file a complaint with the competent supervisory authority. In Austria, the Data Protection Authority is responsible for this.

3. Data Security

The protection of your personal data is ensured through appropriate organizational and technical measures. These measures specifically address protection against unauthorized, unlawful, or accidental access, processing, loss, use, and manipulation. Notwithstanding our efforts to maintain a consistently high standard of due diligence, it cannot be ruled out that information you provide to us via the Internet may be viewed and used by others. Please note that we therefore assume no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorized access by third parties (e.g., hacking of email accounts or phones, interception of faxes).

4. Use of Data

We will not process the data provided to us for any purposes other than those covered by the contract, your consent, or any other provision in accordance with the GDPR. An exception to this is the use of data for statistical purposes, provided that the data provided has been anonymized.

5. Transfer of Data to Third Parties

To fulfill your request, it may also be necessary to transfer your data to third parties (e.g., substitutes, insurance companies, service providers we use and to whom we provide data, etc.). Any transfer of your data will take place exclusively in accordance with the GDPR, specifically to fulfill your request or based on your prior consent. Furthermore, we inform you that, as part of our service, we regularly obtain factual and case-related information about you from third parties. Some of the above-mentioned recipients of your personal data are located outside your country or process your personal data there. The level of data protection in other countries may not correspond to that of Austria. However, we only transfer your personal data to countries for which the EU Commission has determined that they have an adequate level of data protection, or we implement measures to ensure that all recipients maintain an adequate level of data protection, for which we enter into standard contractual clauses (2010/87/EC and/or 2004/915/EC).

6. Disclosure of Data Breaches

We strive to ensure that data breaches are detected early and, if necessary, reported immediately to you or the competent supervisory authority, including the specific categories of data affected.

7. Data Retention

We will not retain data for longer than is necessary to fulfill our contractual or legal obligations and to defend against any potential liability claims.

8. Cookies

This website does not use cookies.

9. Server Log Files

To optimize this website in terms of system performance, user-friendliness, and the provision of useful information about our services, the website provider automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This includes your Internet Protocol address (IP address), browser and language settings, operating system, referrer URL, your Internet service provider, and date/time. This data is not combined with personal data sources. We reserve the right to review this data retrospectively if we become aware of specific indications of unlawful use.
